Can you please specify if you are having the issue the same issue when using the Giants figures with the Giants portal? Does the issue only occur when using the figures on the Swap Force portal? Also, indicate which figures you are receiving the error message.
If you have properly followed the steps listed here Activision Support and you are still experiencing an issue with the toy(s), you may need to submit a Warranty claim. Here's how to do so Activision Support .

I don't have a Giants portal to test this, only have the Swap Force game/portal
I may be able to test on o friends Giants portal I am guessing that if the problem goes away the issue may be the portal and I should be looking to submit a warranty claim for this rather than the 10+ toys I am having issues with?
You mentioned the Giants figure, so naturally I assumed you also had the Giants game/portal.
If you are able to test the Giants figures on a friend's game/portal, that will help identify if the issue is with the figures or the portal. If the Giant figures work without issue, you can certainly submit a Warranty claim for the Swap Force portal.
